APPELLATE BRIEFING & ORAL ARGUMENTS

Appeals vary in complexity. Julie handles appeals from beginning to end, or any part in between, including the notice of appeal, appellate mediation, briefing, or oral argument. She also prepares petitions for interlocutory review, petitions for rehearing, petitions for certiorari, and any other steps along the way.

STAYS, INJUNCTIONS & SUPERSEDEAS BONDS

When the trial court orders something to be done, an appeal does not automatically stop it from happening. Stopping the court’s orders can require additional steps: seeking a stay, an injunction, or helping with a bond for a money judgment. Julie assists with obtaining (or defending against) a stay in the trial and appellate courts. She also coaches clients through questions about obtaining supersedeas bonds (sometimes called appeal bonds).

DISPOSITIVE TRIAL COURT MOTIONS

Sometimes issues are plainly destined for appeal. Julie drafts and reviews motions in the first instance, making them as strong as possible both for the trial court and if they are eventually reviewed on appeal.

POST-TRIAL MOTIONS

The transition between trial court and the appellate court can be confusing. Julie manages the transition period as well as the appeal. Sometimes you will want or need to file post-trial motions after the trial court issues its ruling. Julie can work with you to identify issues and present them to the trial court for review.

The easiest way to win an appeal is to win at trial! Julie can help you make your trial case as strong as possible and identify possible weaknesses and likely appellate issues. Then your case will be ready for appeal regardless of what happens.

MEDIATION & MEDIATION CONSULTATION

The court of appeals often orders mediation in divorce cases. Although divorcing parties have always tried mediating before, appellate mediation can be more successful than you might think. Julie can help you evaluate your risk and likelihood of success on appeal, what type of settlement (if any) would be right for you, and work with the mediator and opposing counsel to reach that resolution. Julie can also help you evaluate the strength of your case before you go to mediation at the trial level.
